Welcome to EasyTitle24.com. EasyTitle24.com provides their services to you
subject to the following conditions. If you use any of the services of
EasyTitle24.com, you accept these conditions. Please read them carefully.
EasyTitle24.com provides Energy Consulting Services that include, but are not
limited to, the purveyance of Energy Compliance Reports under Title 24 of the
California State Building Code. EasyTitle24.com provides 2 levels of service:

The Do-It-Yourself level of service, where Customers submit itemized
information on their design through a web interface, the EasyTitle24 TakeOff
Tools. Customers must register as members to use the Takeoff Tools. There is
no charge for becoming a member. See 'Membership and Your Account' section
below.

The Full-Service level of service, where the Customer submits a CAD
file or other document containing their design, and EasyTitle24.com
extracts compliance information from this design. Customers need not register
as members in order to use this Level of Service.
The fees and and conditions for these two levels of service differ, as described
below. In both cases, EasyTitle24.com delivers a Customized Instrument of
Service that is tailored to the design information submitted by the Customer.
As such, the Customized Instrument of Service has no intrinsic value to anyone
other than to the Customer who requested it. See our

for information on the two levels of service and various types of Base Services
and Premium Services that we provide.
Do-It-Yourself Level of Service
After becoming a member, the Customer may use the EasyTitle24 Takeoff Tools
for as long as he/she needs to provide all the pertinent information on their
design, at no charge. When the Customer deems that the information entered
in the Takeoff Tool faithfully reflects the information contained in his/her
building design project, he/she will request that EasyTitle24.com analyze
this information and deliver a Report. The date and time on which such
request is made is henceforth refered to as the Time of Submission.
Upon receiving the project's specifications from a Customer through the
EasyTitle24 Do-It-Yourself TakeOff tool, one of the Energy Analysts
at EasyTitle24 performs the analytical consulting services requested by the
Customer, and compiles the results into an electronic document. The
resulting document is delivered to the Customer electronically as part of the
basic fee for the service. At the request of the Customer, and for an
additional fee, EasyTitle24.com can mail a printed copy of the report to the
Customer.
Full Service Level of Service
Under this Level of Service, the Customer provides an electronic file or
similar design document to EasyTitle24.com. One of EasyTitle24's Energy
Analysts will promptly contact the Customer to provide an estimate of the
costs of the project and the corresponding anticipated delivery time.
EasyTitle24.com warrants that the results of its analysis are in accordance
with one of the energy analysis algorythms that are approved by the State of
California on the report delivery date. See LIMITED WARRANTY section further
below. Specific delivery procedures depend on the level of service, as
indicated below.
EasyTitle24.com delivers a Customized Instrument of Service that has no
intrinsic value other than to the Customer who requested it. Hence, and
provided that the information contained in the Report delivered is faithful to
the information submitted by the Customer, no refunds will be issued to the
Customer under any circumstances after a Report has been delivered.
If the information submitted by the Customer is complete and sufficient to
fulfill the services requested by the Customer, EasyTitle24.com commits
to delivering the compliance report electronically by the end of 3 business
days from the Time of Submission of the project. If the Report is not
delivered electronically within this period, the Customer is entitled to
a Delayed Report Delivery Rebate equal to 50% of the value of the
Services contracted.
EasyTitle24.com will debit the Customer's credit card at the time that the
completed report is delivered electronically to the Customer, or at the time
that any hard-copies ordered are mailed to the Customer.
After a project is submitted by a Customer and a report is requested, the
Customer may cancel the report request within 2 hours of the Time of
Submission. After this period, any cancellations will be at the discretion
of EasyTitle24.com. In particular, if the cancellation request is made
before the report is delivered, and EasyTitle24 has completed the report
but has not delivered it, EasyTitle24.com, at its discretion, may deliver
the report and charge the client for the service.
In the event that a Title24 Energy Report has been requested, and the
project cannot be shown to be in compliance with the Title 24 regulations
as submitted by the Customer, the following procedures will take effect:
EasyTitle24.com will contact the Customer electronically via email, or
through any other means of communication as provided by the Customer,
within 3 business days of the Time of Submission. Delivery of the report
will be delayed until EasyTitle24.com contacts the Customer and the
Customer indicates the changes to the design, and/or additional compliance
preferences, that he/she would like to make. This date and time shall be
henceforth called the Time of Re-Submission.
Under such circumstances, the Customer will only be eligible for the
Delayed Report Delivery Rebate if the report is delivered later than 3
business days after the Time of Re-Submission, regardless of the original
Time of Submission.
If the Customer chooses to cancel a Report Request for a Non-Compliant
Project/Design, EasyTitle24 may, at its discretion, impose a
Project Evaluation Fee equal to 50% of the Base Services contracted.
If the Customer does not respond and provide the information necessary to
bring the Design into compliance within 10 business days of being informed
of a Non-Compliant project, EasyTitle24 will deem that the Report Request
has been cancelled and may impose the Project Evaluation Fee mentioned
above. EasyTitle24.com may provide extensions of this deadline at its
discretion.
Terms and Conditions for projects submitted under the Full Service will be
negotiated with the Customer at the time that the design is submitted to
EasyTitle24.com.
In order to use the EasyTitle24 Takeoff Tools, you must register as a member
and establish an Account. Membership is free, and you need only provide an
Account Name, Password and valid email address in order to register.
If you become a member, you are responsible for maintaining the confidentiality
of your account and password and for restricting access to your computer, and
you agree to accept responsibility for all activities that occur under your
account or password. EasyTitle24.com provides its service only to adults, age
18 or older, who can purchase them with a credit card. EasyTitle24.com and its
affiliates reserve the right to refuse service, terminate accounts, remove or
edit content, or cancel orders at their sole discretion.
In the resources section of the site, Customers may participate in forums, and
submit suggestions, ideas, comments, questions, or other information, so long
as the content is not illegal, obscene, threatening, defamatory, invasive of
privacy, infringing of intellectual property rights, or otherwise injurious to
third parties or objectionable and does not consist of or contain software
viruses, political campaigning, commercial solicitation, chain letters, mass
mailings, or any form of "spam."
You may not use a false e-mail address, impersonate any person or entity, or
otherwise mislead as to the origin of a card or other content. EasyTitle24.com
reserves the right (but not the obligation) to remove or edit such content, but
does not regularly review posted content.
If you do post non-confidential content or submit material, and unless we
indicate otherwise, you grant EasyTitle24.com and its affiliates a
nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable
right to use, reproduce, modify, adapt, publish, translate, create derivative
works from, distribute, and display such content throughout the world in any
media. You grant EasyTitle24.com and its affiliates and sublicensees the right
to use the name that you submit in connection with such content, if they
choose. You represent and warrant that you own or otherwise control all of the
rights to the content that you post; that the content is accurate; that use of
the content you supply does not violate this policy and will not cause injury
to any person or entity; and that you will indemnify EasyTitle24.com or its
affiliates for all claims resulting from content you supply. EasyTitle24.com
has the right but not the obligation to monitor and edit or remove any activity
or content. EasyTitle24.com takes no responsibility and assumes no liability
for any content posted by you or any third party.
When you visit EasyTitle24.com or send e-mails to us, you are communicating
with us electronically. You consent to receive communications from us
electronically. We will communicate with you by e-mail or by posting notices

arbitration in Richmond, California, except that, to the extent you have in any
manner violated or threatened to violate EasyTitle24.com's intellectual
property rights, EasyTitle24.com may seek injunctive or other appropriate
relief in any state or federal court in the state of California, and you
consent to exclusive jurisdiction and venue in such courts.
Arbitration under this agreement shall be conducted under the rules then
prevailing of the American Arbitration Association. The arbitrator's award
shall be binding and may be entered as a judgment in any court of competent
jurisdiction. To the fullest extent permitted by applicable law, no arbitration
under this Agreement shall be joined to an arbitration involving any other
party subject to this Agreement, whether through class arbitration proceedings
or otherwise.
